Where survey at brick kilns revealed excess or unaccounted bricks and coal not recorded in books and persons present failed to produce documents, initiation of confiscation proceedings with penalty and fine under section 130 was impermissible, as proper procedure required tax determination as if supplied under section 35(6) read with sections 73 and 74, rendering confiscation unsustainable GST: Where excess or unaccounted stock found at respondents' brick kilns led to confiscation and penalty orders, and Commissioner (Appeals) quashed both confiscation and penalty due to lack of legal basis, revenue's appeals confined only to fine could not be sustained in absence of a surviving confiscation, rendering such appeals meritless and not maintainable

Where appellant, facing ITC mismatch between GSTR-3B and GSTR-2A, admitted oversight and paid tax with interest before SCN, but was issued SCN invoking Section 74 for suppression and penalized 100 percent, such invocation was unsustainable since no fraud, mis-statement or deliberate suppression was established and case fell under Section 73, rendering Section 74 action and penalty invalid
GSTAT Bengaluru
Where an assessee made pre-SCN payment of tax and interest for excess ITC and irregular TRAN-1 credit found in audit and there was no evidence of fraud, willful misstatement or suppression with intent, penalty under fraud provisions was not sustainable as mere audit detection does not amount to suppression, and voluntary payment warranted immunity from penalty under general provisions

Where assessee faced SCN alleging ineligible ITC based on suppression for multiple years, but there was no proof of fraud, willful misstatement, or contumacious intent, and statutory reconciliations were properly disclosed, mere availment of self-assessed ineligible ITC did not amount to suppression, so demands under section 74 could not be sustained and appeal was allowed. GST: Where SCN under section 74(1) alleged suppression due to ineligible ITC but did not mention non-reply to audit queries or final audit report and Revenue for first time in appeal raised failure to furnish audit information, such new ground violated natural justice as it lacked specificity, proof of willful suppression, or statutory foundation, rendering appellate reversal unsustainable and assessee's appeals allowable

Where e-commerce operator transitioned pre-GST CENVAT and VAT credits to GST through TRAN-1 and no proceedings challenging eligibility of such credits were initiated or pending under erstwhile laws, initiation of recovery and denial of transitional credit solely at transition stage under GST Acts was beyond jurisdiction and unsustainable, as transitional provisions did not authorize fresh proceedings for admissibility under repealed laws. GST: Where appellant transitioned undisputed CENVAT credit via TRAN-1, authorities would be barred from reassessing correctness of erstwhile credits invoking transitional provisions, as invoice-level matching was futile for closing balances and ancillary discrepancies like mismatch of address or absence of description could not defeat transition; denial of transitioned input tax credit was unsustainable. GST: Where appellant transitioned Krishi Kalyan Cess (KKC) credit via TRAN-1 but later on they had to reverse it under protest being doubted by Department, denial of transition based on retrospective amendment and departmental circular was not sustainable since no notification had operationalised its exclusion and precedent of jurisdictional High Court as well as independent statutory reading supported transition, thus, making appellant's transition of KKC in order. GST: Where assessee transitioned CENVAT credit and VAT ITC balance on stock-in- trade as of 30.06.2017 and provided all requisite details without any specific objections or contrary evidence from revenue, generic allegations of missing documents could not justify denial in absence of any specific finding or material against assessee's claim.…
